If you hold a Commercial Driver’s License (CDL) or work in a DOT-regulated safety-sensitive position, a drug or alcohol violation places you out of compliance with federal regulations.
Before you can return to safety-sensitive work, you are required by the Federal Motor Carrier Safety Administration (FMCSA) to complete the Substance Abuse Professional (SAP) return-to-duty process.

We work with drivers, employers, and third-party administrators to ensure each step of the process is completed correctly and reported through the FMCSA Clearinghouse.

What Is a SAP Evaluation?
A SAP evaluation is a federally mandated clinical assessment completed by a DOT-qualified Substance Abuse Professional.
The purpose of the evaluation is to determine what level of education and/or treatment is required before an individual can be considered for return to safety-sensitive duty.
This is not optional and must be completed before an employer is permitted to allow a return to work.
The SAP evaluation is structured, standardized, and must follow federal DOT guidelines.
Who Is Required to Complete the SAP Process?
You are required to complete the SAP process if you:
Failed a DOT drug or alcohol test
Refused a required DOT drug or alcohol test
Are listed in the FMCSA Drug and Alcohol Clearinghouse as prohibited
Have been directed by your employer, consortium, or DOT authority to complete the SAP process

The DOT SAP Return-to-Duty Process
The SAP process is federally regulated and must be completed in a specific order. Each step must be documented and reported.
Step 1
Initial SAP Evaluation
The process begins with the initial clinical evaluation. During this appointment, the SAP will:
Review your DOT violation (drug or alcohol)
Review relevant substance use, work, and medical history
Provide a written recommendation for required services
At the end of this appointment, you will receive a structured plan that must be completed before moving forward.
Complete a clinical assessment
Determine whether education, treatment, or both are required
Step 2
Education and/or Treatment
Based on the SAP recommendation, you are required to complete a structured program. This may include:
Substance use education programs
Outpatient counseling or treatment
Individual or group therapy
Additional recommendations based on clinical need
The SAP does not provide this treatment but approves what must be completed and monitors compliance with the recommendation. You cannot proceed to the next step until all required services are fully completed.
Step 3
Documentation of Completion
Once you complete the required education or treatment, documentation must be submitted showing completion.
This documentation is reviewed by the SAP to verify that all requirements have been met exactly as outlined. Incomplete or non-compliant programs are not accepted under DOT regulations.
Step 4
Follow-Up SAP Evaluation
After all requirements are completed, you return for a follow-up evaluation. During this appointment, the SAP:
Reviews completion documentation
Conducts a follow-up clinical assessment
Confirms compliance with all recommendations
Determines whether you are eligible for return to duty
Step 5
Return-to-Duty Determination
If all requirements are met, the SAP issues a formal return-to-duty determination.
This allows your employer to proceed with DOT return-to-duty testing and reinstatement into safety-sensitive work. Without this determination, you cannot legally return to duty.
Step 6
FMCSA Clearinghouse Reporting
All SAP evaluations and determinations are reported through the FMCSA Drug and Alcohol Clearinghouse. This includes:
Initial violation status (prohibited)
Completion of SAP recommendations
Return-to-duty eligibility status
Employer notification for testing authorization
Follow-up testing plan requirements (if applicable)
This reporting is federally required and time-stamped in the Clearinghouse system.
How Long Does the SAP Process Take?

The length of the SAP process depends entirely on how quickly required education or treatment is completed.
Some individuals complete the process in a few days. Others take longer depending on scheduling availability and level of required care.
The SAP process cannot be expedited without completing all required steps in full.

Frequently Asked Questions
If you perform DOT-regulated safety-sensitive duties, you cannot return to those duties until you have successfully completed every step of the Return-to-Duty process. This includes completing your SAP's recommendations, receiving a successful follow-up evaluation, taking a negative Return-to-Duty drug and/or alcohol test, and being released by your employer to resume safety-sensitive work. Depending on your employer's policies, you may be able to work in a non-safety-sensitive position while completing the process.
Your Substance Abuse Professional (SAP) determines the type and level of education or treatment you must complete and serves as a referral source to help you enter an appropriate program. If you are considering another provider, you should discuss it with your SAP before beginning services. Your SAP must be able to verify that you have successfully complied with the recommendations before you can move forward in the Return-to-Duty process.
Yes. If you are subject to FMCSA regulations, your DOT drug and alcohol program violation will be reported to the FMCSA Drug and Alcohol Clearinghouse. After you successfully complete the Return-to-Duty process, your Clearinghouse record will be updated to reflect that you have completed the required steps. However, the violation remains in the Clearinghouse for the period required by federal regulations.
No. The follow-up evaluation is a mandatory part of the DOT Return-to-Duty process. Once you have completed your recommended education or treatment, you must return to your SAP for a follow-up evaluation. During this evaluation, your SAP determines whether you have successfully complied with the recommendations and are eligible to continue the Return-to-Duty process. Without a successful follow-up evaluation, you cannot return to DOT-regulated safety-sensitive duties.
There is no set timeline for the DOT SAP process. The length of the process depends on your individual circumstances and your SAP's clinical recommendations. Some individuals complete the required education or treatment in just a few days, while others require additional time. The process is based on successful compliance with your SAP's recommendations rather than a predetermined schedule.
Your employer or designated employer representative (DER) typically provides a referral to a qualified DOT Substance Abuse Professional (SAP). If you are responsible for finding your own SAP, you must choose one who is qualified under DOT regulations. Only a DOT-qualified SAP can conduct the evaluations and monitor compliance required for the Return-to-Duty process.
